1. Booking & scope
These terms apply to real estate photography and any related media specifically included in a written quote from Thaddeus Harden Photography LLC (“Photographer”). The person or business placing the order is the “Client.” The property address, services, price, delivery schedule and any special requirements will be confirmed in writing before the appointment.
Only quoted services are included. Video, aerial photography, floor plans, virtual tours, twilight photography, virtual staging and extensive retouching are separate services when available. No service is promised merely because it is mentioned in these terms.
The Client must receive and accept these terms in writing or through an affirmative booking acknowledgment before the appointment is confirmed. A written agreement accepted by both parties controls over any conflicting provision here. Later website changes do not alter a previously accepted booking.
2. Property readiness & access
The property must be clean, staged and camera ready before the scheduled arrival window begins. The Client is responsible for arranging access, confirming entry instructions, obtaining owner or occupant permission, and securing pets and valuables.
Before arrival: clear counters and personal items; make beds; hide cords, trash bins and cleaning supplies; turn on working lights; open window coverings as appropriate; and remove vehicles from the driveway when practical. Cleaning, staging and moving heavy furniture are not included.
Provide any priority views, features or areas to avoid before the appointment, or meet the photographer at the start. Otherwise, the Photographer will select views using professional judgment.
A property that is accessible but unprepared may be photographed as found. If access is unavailable or the appointment cannot proceed because of readiness or safety issues, the late cancellation policy applies. Additional time or a return visit requires an agreed additional fee.
3. Order accuracy & changes
Provide the correct address, approximate square footage, property type, requested coverage and access details. Quotes rely on this information. If the scope or property size differs materially, the Photographer will explain any price adjustment and obtain approval before performing additional work. If the Client declines, the parties will agree on reduced coverage or a new appointment.
4. Rescheduling, cancellations & weather
Appointments canceled or rescheduled by the Client less than 24 hours before the scheduled start are subject to a $50 fee. The same fee applies to a missed appointment or a property that cannot be accessed or safely photographed. Any separate, nonrefundable third-party expenses require advance written approval.
Weather that prevents the booked work from being completed safely or effectively will be discussed with the Client and the affected work rescheduled without the $50 fee. Interior coverage may proceed by agreement. A preference for different weather, when the work can otherwise proceed, is subject to the normal cancellation policy.
Aerial services, if separately booked and available, depend on lawful flight authorization, airspace restrictions, weather and safe operating conditions. The Photographer may decline or stop an unsafe or prohibited flight. If a booked component cannot be provided, the parties will agree to reschedule it or refund the unperformed component.
If the Photographer must cancel and a mutually acceptable replacement date cannot be arranged, payments for unperformed services will be refunded.
5. Payment & delivery
Unless otherwise agreed in writing, payment in full is required before unwatermarked, downloadable files are released and usage rights begin. An invoice or payment link will be provided. Any reservation payment and its refund terms must be stated in the accepted quote.
The delivery deadline will be stated in the booking confirmation. It begins after the shoot is completed and any required Client information is received. Payment delays may delay release. Applicable taxes and all agreed additional charges will be shown on the invoice.
New bookings may be paused while an account has an overdue balance. These terms do not impose automatic monthly late fees or authorize disabling media already paid for.
6. Service area & travel
Travel is measured by one-way driving distance from the Keller studio at 460 Keller Parkway, Keller, Texas. The trip fee is charged once per appointment and confirmed in the quote.
0–30 miles: no trip fee. More than 30–60 miles: $15. More than 60–150 miles: $75. More than 150–200 miles: $99. Properties beyond 200 driving miles are outside the standard service area and require a separate written agreement.
Parking, tolls, special access charges or other travel expenses apply only if disclosed and accepted before booking.
7. Editing, corrections & file retention
Delivery includes the Photographer’s selection and standard editing for the booked service. Raw files, unselected images and layered working files are not included. Changes to property features, object removal and virtual staging require a separate agreement and must comply with applicable advertising and MLS requirements.
Please report missing files, technical defects or requested corrections within seven calendar days of delivery. Errors attributable to the Photographer will be corrected without additional charge. New creative requests, changed staging or return visits caused by property conditions may incur an agreed fee. This reporting request does not waive rights provided by law.
Download and back up delivered files promptly. Online galleries and long-term file storage are not guaranteed.
8. Copyright & permitted use
The Photographer retains copyright in the photographs and other original media created for the assignment (“Work”). Copyright is not transferred by paying for the service. The Photographer will obtain any contributor rights needed to grant the license described below.
After full payment, the Client and the brokerage identified in the booking receive a nonexclusive license to use delivered final files worldwide to market the photographed property during their listing agreement, in print, on websites, on social media and in paid advertising. They may provide files to their MLS, listing portals and marketing vendors only as needed for that listing.
The license includes platform reproduction, distribution and display reasonably necessary for listing publication, ordinary syndication, and customary sold-listing archives. The Client must disclose before booking any MLS or platform terms requiring a copyright assignment or broader rights so a separate agreement can be considered.
After the listing ends, the Client and identified brokerage may retain the photographs indefinitely in their own business portfolio, social posts and marketing about their completed work. This does not authorize a new listing, another agent’s marketing, rental advertising or an unrelated commercial campaign.
The license is otherwise nontransferable. Owners, builders, designers, stagers, other agents and other businesses must obtain a separate license for their own use. The Client may not sell the files, sublicense unrelated uses or represent the Work as their own photography. Normal cropping, resizing, text overlays and layout are permitted; material alterations require written approval.
9. Permissions, privacy & portfolio
The Client represents that they have authority to commission the work and arrange lawful access, photography and publication for the agreed marketing use. The Client must obtain necessary permissions from owners and occupants, identify confidential areas or items before the shoot, and remove personal information or objects they do not want photographed.
Portfolio use by the Photographer is permitted only to the extent authorized by the property owner or another person with authority to grant that permission. The Client must disclose any restrictions before booking. If the Client cannot authorize portfolio use, separate permission will be obtained before such use. No blanket waiver of an occupant’s privacy is assumed.
These terms do not authorize unrelated stock licensing, resale or third-party commercial use of property images based solely on the Client’s booking.
10. Responsibility & disputes
Each party is responsible for its own negligent or wrongful conduct and breach of this agreement. To the extent permitted by law, the Client will reimburse the Photographer for reasonable third-party claims, damages and costs caused by the Client’s breach of the permission or license provisions, excluding any portion caused by the Photographer’s negligence or misconduct.
The Photographer does not guarantee a sale, rental, listing price or marketing result. Floor plans or measurements, if separately supplied, are for marketing reference and are not surveys or appraisals; the Client must verify them before publication.
Please raise concerns promptly so the parties can attempt a practical resolution. Texas law governs, subject to applicable federal law. Nothing in these terms limits rights or remedies that cannot legally be waived.
